On November 16, 2021, the Ministry of Planning and Investment of Vietnam promulgated Circular 09/2021/TT-BKHĐT guiding the selection of investors to implement investment projects in the form of public-private partnerships and investment projects using land.
According to the Circular, the regulations on investment projects using land specified in Clause 1, Article 11 of Decree 25/2020/ND-CP of Vietnam are determined according to the following provisions:
- Urban areas are determined according to the provisions of Clause 1, Section VII, Appendix IX issued together with Decree 15/2021/ND-CP.
- Commercial housing is determined according to the provisions of Clause 4, Article 3 of the Law on Housing of Vietnam
- Headquarters and office buildings, including buildings used as offices in combination with accommodation, are determined according to the provisions of Point h, Clause 2, Section I, Appendix I promulgated together with Decree 06/2021/ND-CP of Vietnam
- Commercial works, including trade centers, supermarkets, shops; restaurants, and food, and beverage shops are determined according to the provisions of Point e, Clause 2, Section I, Appendix I issued together with Decree 06/2021/ND-CP.
- Service works include hotels, guest houses, motels; resort facilities; Accommodation villas, apartments and other accommodation service establishments shall be determined according to the provisions of Point g, Clause 2, Section I, Appendix I issued together with Decree 06/2021/ND-CP.
Circular 09/2021/TT-BKHDT of Vietnam takes effect from January 1, 2022 and replaces Circular 06/2020/TT-BKHDT.
