Regulations on the establishment of Sub-Departments under the Department of Agriculture and Rural Development in Vietnam

The Minister of Agriculture and Rural Development of Vietnam issued Circular 30/2022/TT-BNNPTNT dated December 30, 2022 guiding the functions, tasks and powers of specialized agencies on agriculture and rural development under the People's Committees of provinces and districts.

According to Vietnam's Circular 30/2022/TT-BNNPTNT, the establishment of a branch under the Department of Agriculture and Rural Development (including internal organizations) must comply with the provisions of specialized laws and satisfy the criteria for establishment according to the provisions of Vietnam's Decree 107/2020/ND-CP (amending Decree 24/2014/ND-CP).

In the case of establishing a specialized management branch under the Department, the divisional organization of the branch shall be arranged in accordance with the criteria specified in Vietnam's Decree 107/2020/ND-CP;

If the criteria for establishment of a branch are not satisfied, or the criteria for establishment of a branch are not satisfied, the Department shall report to the provincial People's Committee for consideration of consolidation, merger, and reorganization of its branches.

Or organizing a professional division under the Department to perform tasks related to that industry or field.

Vietnam's Circular 30/2022/TT-BNNPTNT effective from March 31, 2023.
