Regulations on seeking individuals for adoption in Vietnam from January 08, 2025

On January 08, 2025, the Government of Vietnam promulgated Decree 06/2025/ND-CP amending certain Decrees on adoption.

Regulations on seeking individuals for adoption in Vietnam from January 08, 2025

The process of finding adoptive parents for children in Vietnam is carried out as follows:

- (*) Upon receiving a child's file as stipulated in clauses 1 and 2 of Article 6 of Decree 19/2011/ND-CP, if there is a Vietnamese citizen permanently residing in the country registering to adopt a child as per Article 16 of the Adoption Law 2010, the Department of Justice will check the adoptive parent's eligibility before handing over one copy of the child's file to the adoptive parent and introduce them to the competent local People’s Committee for adoption proceedings in accordance with the law.

In the case where no Vietnamese citizen permanently residing in the country registers to adopt, the Department of Justice will announce the search for adoptive parents for the child according to the method and period stipulated in point c, clause 2, Article 15 of the Adoption Law 2010;

- Within the period when the announcement covers the provincial level, if there is a Vietnamese citizen permanently residing in the country who registers to adopt a child as per Article 16 of the Adoption Law 2010, the Department of Justice will proceed according to regulation (*).

After the notification period ends, if no Vietnamese citizens permanently residing in the country adopt the child, the Department of Justice sends the list of children to the Ministry of Justice to announce the search for adoptive parents according to the method and period stipulated in point d, clause 2, Article 15 of the Adoption Law 2010;

- During the national announcement period, if a Vietnamese citizen permanently residing in the country wishes to and meets the conditions to adopt a child, they should contact the Department of Justice to proceed according to regulation (*).

When the national announcement period ends and no Vietnamese citizens permanently residing in the country adopt the child, for children stipulated in clause 2, Article 6 of Decree 19/2011/ND-CP, the Ministry of Justice will notify the Department of Justice to confirm the child is eligible for foreign adoption.

For children as stipulated in clause 1, Article 6 of Decree 19/2011/ND-CP, if no Vietnamese citizens permanently residing in the country adopt the child, the Ministry of Justice will inform the Department of Justice to request the local People's Committee to file for bringing the child to a nurturing institution if the child is not otherwise cared for in accordance with the law.

If the nurturing institution assesses that the child needs to be adopted and prepares the child’s file as stipulated in clause 2, Article 6, Decree 19/2011/ND-CP, it is not necessary to repeat the announcement for finding domestic adoptive parents;

- The notification content seeking adoptive parents for children must ensure the privacy rights, personal and family confidentiality of children as stipulated by law.
