Regulations on revocation and temporary suspension of the use of specialized inspection cards in information and communications in Vietnam

On December 13, 2024, the Minister of Information and Communications of Vietnam issued Circular 15/2024/TT-BTTTT stipulating certain contents regarding specialized inspection in the field of information and communications. It clearly stipulates the dossiers required for the issuance, replacement, and reissuance of the specialized inspection cards for the information and communications sector.

The Director of the Department assigned the function of sector inspection sends a document to the Ministry Inspectorate requesting the revocation or suspension of the use of the Card of the individual assigned the task of sector inspection, in accordance with the Official Dispatch request for revocation or suspension of use of the sector inspector card as prescribed in Appendix 07 issued with Circular 15/2024/TT-BTTTT.

- The Ministry Inspectorate is responsible for compiling and submitting to the Minister for consideration and signing the Decision to revoke or suspend the use of the sector inspector card. The template for the Decision to revoke or suspend the use of the sector inspector card is prescribed in Appendix 08 issued with Circular 15/2024/TT-BTTTT.

- Individuals assigned the task of sector inspection are temporarily suspended from using the Sector Inspector Card in the following cases:

+ Violation of the law during inspection activities as stipulated by law, without a final decision;

+ Being temporarily suspended from work for disciplinary consideration;

+ Being prosecuted, detained, or arrested.

- Individuals assigned the task of sector inspection will have their Sector Inspector Card revoked in the following cases:

+ Transferring work to a different agency or unit or no longer being assigned the task of sector inspection, retirement, resignation, or death while in service;

+ Being convicted by a court with a legally effective criminal judgment or being disciplined with one of the following forms: demotion, demotion to a lower position, dismissal, compulsory resignation;

+ Loss of civil act capacity.

- After the competent authority issues a conclusion proving that the person issued the Card did not violate the law during the performance of duties or after the disciplinary period is over, the Director of the Department assigned the function of sector inspection shall send a document to the Ministry Inspectorate requesting the Minister of Information and Communications to issue a Decision to terminate the suspension of use of the Sector Inspector Card. The template for the Decision to terminate the suspension of use of the Sector Inspector Card is prescribed in Appendix 09 issued with Circular 15/2024/TT-BTTTT.
