Regulation on suspension of educational activities in preschools in Vietnam from November 20, 2024

On October 5, 2024, the Government of Vietnam issued Decree 125/2024/ND-CP stipulating the conditions for investment and operations in the field of education.

Regulation on suspension of educational activities in preschools in Vietnam from November 20, 2024

Pursuant to Article 7 of Decree 125/2024/ND-CP, the regulations concerning the suspension of educational activities in preschools in Vietnam are stipulated as follows:

(1) A preschool in Vietnam shall have its educational activities suspended if it falls into one of the following cases:

i) Engaging in fraudulent acts to obtain permission for educational activities;

ii) The individual granting permission for educational activities lacks the proper authority;

iii) Failing to commence educational activities within one year from the date permission for activities was granted;

iv) Violating legal regulations on education and being subject to administrative sanctions at a level necessitating the suspension of educational activities;

v) Other cases as prescribed by law.

(2) The Head of the Education and Training Department shall decide on the suspension of educational activities for preschools.

(3) Implementation procedure:

- Upon detecting that a preschool violates one of the cases specified in (1), the Head of the Education and Training Department shall organize an inspection to assess the actual situation, draft an inspection report, and notify the preschool of the violation;

- Within 10 days from the date of notifying the preschool of the violation, the Head of the Education and Training Department, based on the extent of the violation, shall decide on the suspension of educational activities and report to the district People’s Committee.

The decision to suspend educational activities for a preschool (according to Form No. 10 Appendix I attached to Decree 125/2024/ND-CP) is publicly announced in the mass media;

- During the suspension period, if the cause leading to the suspension is rectified, the preschool shall inform the Head of the Education and Training Department in writing, with evidence included. Within 7 working days from the date of receiving the preschool's notification, the Head of the Education and Training Department shall decide to allow the preschool to resume educational activities and publicly announce it in the mass media;

- In case of suspension as prescribed at point (ii) of (1), within 5 working days from the date of issuing the suspension decision, the Head of the Education and Training Department shall review the preschool’s educational operation conditions. If it meets the provisions of Article 5 of Decree 125/2024/ND-CP, a decision shall be made allowing the preschool to resume educational activities and publicly announced in the mass media.
