Promulgation of the Regulation on environmental safety distance for residential areas in Vietnam

The Minister of Natural Resources and Environment of Vietnam issued Circular 02/2025/TT-BTNMT on February 12, 2025, regarding the National Technical Regulations on safe environmental distance for residential areas from production, business, service establishments, and storages that pose risks of dust emission, unpleasant odors, noise, adversely affecting human health.

The national technical regulation on environmental safety distances for residential areas concerning production, business, service facilities, and warehouses that have the potential to emit dust, unpleasant odors, and noise negatively affecting human health, code QCVN 01:2025/BTNMT, is issued together with this Cicular

This regulation applies to state agencies, organizations, and individuals (hereinafter referred to as organizations and individuals) related to the environmental safety distances concerning residential areas of production, business, service facilities, and warehouses that have the potential to emit dust, unpleasant odors, and noise negatively affecting human health within the territory of Vietnam.

This regulation does not apply to production, business, service facilities, and warehouses located in concentrated production, business, service areas, industrial clusters, and centralized waste treatment areas.

Refer to detailed content in Circular 02/2025/TT-BTNMT, which takes effect 6 months from the date of signing and promulgation.

Note:

- Production, business, service facilities, and warehouses currently operating and investment projects that have been approved for location research, planning, and site introduction, or have received investment approval, decision, or granted investment registration certificates before this regulation's effective date have complied with the provisions of QCVN 01:2021/BXD - The national technical regulation on Construction Planning issued together with Circular 01/2021/TT-BXD and shall continue to adhere to the approved decisions until the end of the investment project period. In case of adjusting the investment project or facilities operating with an increase in negative impacts on human health after the effective date of this regulation, compliance with this regulation is required.

- Entities specified above that cause environmental pollution or negatively affect human health must undertake one of the following actions:

+ Project owners or facilities must review and improve environmentally friendly technology, applying the best available techniques to ensure compliance with environmental technical standards.

+ Relocate the facilities to sites meeting the requirements of this regulation according to the timetable specified by the provincial People's Committee.
