On December 31, 2024, the Government of Vietnam issued Decree 182/2024/ND-CP providing for the establishment, management, and use of the Investment Support Fund.
Decree 182/2024/ND-CP stipulates the establishment, management, and use of the Investment Support Fund in Vietnam (hereinafter referred to as the Fund). This decree applies to the Fund, enterprises established and operating under Vietnamese law that meet the criteria and conditions in Decree 182/2024/ND-CP, and agencies, organizations, and individuals related to the establishment, management, and use of the Fund.
According to Decree 182/2024/ND-CP, the Investment Support Fund is a national fund established by the Government of Vietnam, assigned to the Ministry of Planning and Investment for management; it operates without the objective of profit or preserving the financial resources of the Fund. The Fund is under the Ministry of Planning and Investment, functioning similarly to a public service provider, following specific regulations on organization and operational mechanisms stipulated in Decree 182/2024/ND-CP.
The Fund has legal status, is allowed to use its own seal, and can open budget accounts at the State Treasury to receive funding from the state budget, and open accounts at the State Treasury or commercial banks for non-state budget sources.
The Investment Support Fund has the function of managing and coordinating its financial resources to support the entities defined in Decree 182/2024/ND-CP.
The tasks of the Investment Support Fund include:
- Receiving, managing, and utilizing state budget allocations and other lawful sources, in accordance with Decree 182/2024/ND-CP and other regulations related to the Fund’s activities;
- Providing financial support to businesses according to the subjects, conditions, content, and levels of support as specified in Decree 182/2024/ND-CP;
- Implementing policies for reporting, financial management, accounting, auditing, and other regulations relating to the Fund’s operations in compliance with Decree 182/2024/ND-CP and relevant legal provisions.
