On December 30, 2024, the Minister of Construction of Vietnam promulgated Circular 14/2024/TT-BXD regarding the procedures for safety assessment of structures during operation and utilization in Vietnam.
This procedures apply to structures specified in Appendix XI of Decree 175/2024/ND-CP, detailing certain articles and measures for the implementation of the Construction Law concerning the management of construction activities and under the state management authority of the Ministry of Construction.
These procedures are applied to inspect and assess the working capacity of main load-bearing structures, parts of structures that pose a risk of loss of safety, and conditions ensuring the normal operation and exploitation of the structure as specified in clauses 1 and 2 of Article 37 of Decree 06/2021/ND-CP of the Government of Vietnam, detailing certain contents on the management of quality, construction execution, and maintenance of construction projects.
These procedures do not apply to the following cases:
- Structures with incidents;
- Insufficient collection of necessary information to conduct safety inspections and assessments of the structure;
- Determining the remaining lifespan of the structure.
General provisions on the procedure for safety assessment of structures during operation and use are as follows:
- The assessment of the structural safety of the structure must apply technical regulations and standards that are in effect at the time of assessment, using natural condition data used in construction in Vietnam.
- Records and documents used in the safety assessment of structures must ensure legal compliance as prescribed by law.
- The assessment organization must gather sufficient necessary information to conduct safety assessments of structures following the regulations of this procedure.
- The repair and reinforcement of structural elements arising (if any) during the process of safety inspection and assessment must comply with the provisions of construction law.
- In case legal documents cited in this procedure are amended, supplemented, or replaced, the provisions of the latest legal documents will apply.
