On November 21, 2024, the Government of Vietnam issued Decree 153/2024/ND-CP stipulating the environmental protection fee for emissions.

Decree 153/2024/ND-CP stipulates the subjects liable to the fee and fee payers; the fee-collecting organizations; the method of fee calculation, fee rates, declaration, assessment of declarations, fee payment, management, and use of environmental protection fees for emissions.

The subjects liable to the environmental protection fee for emissions, as stipulated in Decree 153/2024/ND-CP, include dust and industrial emissions discharged into the environment requiring treatment from projects, production facilities, business, and service establishments that must have an environmental permit according to environmental protection laws, which includes licensing for emissions discharge (hereinafter referred to as "emission-discharge facilities").

Emission-discharge facilities as regulated in Decree 153/2024/ND-CP include:

- Iron, steel, metallurgy production facilities (excluding rolling, drawing, casting from ingot materials);

- Basic inorganic chemical production facilities (excluding industrial gases), inorganic fertilizers, and nitrogen compounds (excluding mixing, extracting, packaging), chemical plant protection products (excluding mixing, extracting);

- Oil refining, chemical processing facilities;

- Facilities for recycling, treating household solid waste, ordinary industrial solid waste, hazardous waste; using imported scrap materials from abroad as raw materials for production;

- Coke production facilities, coal gas production facilities;

- Thermal power plants;

- Cement manufacturing facilities;

- Other production, business, and service establishments generating dust and industrial emissions not falling under the aforementioned cases.

The fee payers for environmental protection fees concerning emissions are the emission-discharge facilities defined in Clause 1 Article 3 of Decree 153/2024/ND-CP.

More details can be found in Decree 153/2024/ND-CP which takes effect from January 05, 2025.

Payment of environmental protection fees concerning emissions as stipulated in Decree 153/2024/ND-CP does not serve as a basis for confirming the lawful discharge of emissions by emission-discharge facilities. Facilities violating the laws on environmental protection will be handled according to the environmental protection legal provisions.
