Promulgating a new Decree on penalties for road traffic violations in Vietnam in 2025

Decree 168/2024/ND-CP stipulates:

- Sanctioning administrative violations related to order and traffic safety in the field of road traffic, including: acts of administrative violations; forms, levels of penalties, and remedial measures for each administrative violation; authority to prepare records, authority for sanctioning, specific fines according to each position in the administrative violation of order and traffic safety in the field of road traffic;

- The point deduction on driver's licenses for each administrative violation; the procedures, authority to deduct points, restore points on driver's licenses to manage compliance with the law on road traffic order and safety by drivers.

- Administrative violations in other fields of state management related to order and traffic safety in the field of road traffic that are not stipulated in Decree 168/2024/ND-CP shall be sanctioned in accordance with decrees prescribing sanctions for administrative violations in those fields.

Decree 168/2024/ND-CP is applicable to the following entities:

- Vietnamese individuals and organizations; foreign individuals and organizations that commit administrative violations related to order and traffic safety in the field of road traffic within the territory of the Socialist Republic of Vietnam.

- The aforementioned organizations include:

+ State agencies committing violations that are not within the state management duties assigned;

+ Public service units;

+ Political-social organizations, political-social-professional organizations, social organizations, and professional social organizations;

+ Economic organizations established under the provisions of the Law on Enterprises including private enterprises, joint-stock companies, limited liability companies, partnerships, and dependent units of enterprises (branches, representative offices);

+ Economic organizations established under the provisions of the Law on Cooperatives including: cooperative groups, cooperatives, unions of cooperatives;

+ Driver training institutions, driving test centers, vehicle inspection centers, establishments for testing, manufacturing, assembling, importing, warranting, and maintaining motor vehicles, specialized motorcycles;

+ Other organizations established in accordance with legal regulations;

+ Foreign agencies and organizations authorized by the competent authorities of Vietnam to operate within Vietnam's territory.

- Business households, family households committing administrative violations as stipulated in Decree 168/2024/ND-CP shall be sanctioned as individuals who violate.

- Individuals with authority to prepare records of administrative violations, authority to impose sanctions for administrative violations, and organizations and individuals involved in sanctioning administrative violations according to the provisions of Decree 168/2024/ND-CP.

- Individuals with authority to deduct points and restore points on driver's licenses.
