Process for issuing remanufacturing codes in Vietnam under EVFTA and UKVFTA

the Government of Vietnam issued Decree 66/2024/ND-CP dated June 17, 2024, on management of importation of remanufactured goods according to Decree on management of importation of remanufactured goods under the EU-Vietnam Free Trade Agreement and the UK-Vietnam Free Trade Agreement.

Process for issuing remanufacturing codes in Vietnam under EVFTA and UKVFTA

The process for issuing remanufacturing codes in Vietnam under EVFTA and UKVFTA is as follows:

- In case the document is incomplete, conformable, within 07 days from the date of receipt of the document, the Ministry of Industry and Trade of Vietnam shall notify in writing (or online, if applicable) the requesting enterprise to supplement and complete it.

- In case it does not fall under the provisions of Clause 3 Article 13 of Decree 66/2024/ND-CP, within 07 days from the date of receipt of the complete, conformable document, the Ministry of Industry and Trade of Vietnam shall send the document to the specialized management ministry for assessment.

Within 90 days from the date of receipt of the official dispatch requesting the assessment of the Ministry of Industry and Trade of Vietnam, the specialized management ministry shall evaluate the document and reply in writing to the Ministry of Industry and Trade of Vietnam on whether to agree or disagree with issuing the Refurbishment Code. In case of disagreement, the specialized management ministry shall clearly state the reasons.

Within 07 days from the date of receipt of the written response from the specialized management ministry, the Ministry of Industry and Trade of Vietnam shall issue the Refurbishment Code or issue a written refusal, clearly stating the reasons.

- In case the requesting enterprise applies for registration of the refurbished goods category only under Appendix IV of Decree 66/2024/ND-CP, within 90 days from the date of receipt of the conformable document, the Ministry of Industry and Trade of Vietnam shall evaluate the document and issue the Refurbishment Code to the requesting enterprise. In case of refusal to issue, it must reply in writing and clearly state the reasons.

- In case the Ministry of Industry and Trade of Vietnam or the specialized management ministry requests the requesting enterprise to supplement information, the time interval from when the request for additional information is sent to when the valid additional information is received shall not be counted in the time limit for document assessment.
