Procedures for Recognizing Foreign digital signature authentication Providers in Vietnam from August 15, 2024

July 01, 2024, the Minister of Information and Communications (Hanoi, Vietnam) issued Circular 06/2024/TT-BTTTT stipulating the recognition of foreign digital signature authentication providers in Vietnam; recognizing foreign digital signatures and digital certificates in Vietnam.

Procedures for Recognizing Foreign digital signature authentication Providers in Vietnam from August 15, 2024

The procedures for recognizing foreign digital signature authentication providers in Vietnam are as follows:

- Foreign digital signature authentication providers should submit the recognition application to provide digital signature authentications in Vietnam through one of the following methods, either directly, by post, or online as per the guidelines below:

+ Submit directly or by post to the Ministry of Information and Communications (National Electronic Authentication Service Provider), address 18 Nguyen Du - Hai Ba Trung - Hanoi.

+ Submit online through the national public service portal (National Public Service Portal, https://dichvucong.gov.vn or the Ministry of Information and Communications' public service portal, https://dichvucong.mic.gov.vn).

+ Documents issued, recognized, or certified by a competent foreign authority must be consularly legalized in accordance with Vietnamese law (unless exempted from consular legalization as per the law on consular legalization) and must be translated and notarized into Vietnamese.

- Within 45 days from the date of receipt of valid dossiers, the Ministry of Information and Communications (National Electronic Authentication Service Provider) will cooperate with the Ministry of Public Security (Hanoi, Vietnam) to review, assess the dossiers, and verify the status of the electronic signature certificates of the service providers requesting recognition in Vietnam.

- If all conditions are met:

+ The Ministry of Information and Communications (Hanoi, Vietnam) will issue a recognition certificate to the foreign digital signature authentication provider in Vietnam. The recognition certificate form follows Form No. 02 attached to this Circular.

+ The National Electronic Authentication Service Provider will recognize and publish the electronic signature certificates of the foreign digital signature authentication provider on the trusted service certification system.

- If conditions are not met, the Ministry of Information and Communications (Hanoi, Vietnam) will notify and clearly state the reasons.

- In cases where the procedure is carried out in the electronic environment via online public service, the receipt, processing of dossiers, and the delivery of results will be conducted according to the Government of Vietnam's regulations on the implementation of administrative procedures in electronic environments, and the provision of online public services by state agencies in electronic environments and electronic transaction laws.

More details can be found in Circular 06/2024/TT-BTTTT which takes effect in Vietnam from August 15, 2024.
