The Prosecutor General of the Supreme People's Procuracy issued Circular 01/2024/TT-VKSTC dated April 24, 2024, regulating the appointment, reappointment, dismissal, and removal of the heads and deputy heads of the investigating agencies, investigators or investigative officers under the investigating agencies of the Supreme People’s Procuracy in Vietnam.
No later than 90 days before the end of the appointment term of the heads and deputy heads of the investigating agencies in Vietnam, the investigating agencies shall cooperate with the Personnel Department to carry out the reappointment procedure as follows:
- The reappointed heads and deputy heads of the investigating agencies shall draft a self-review report, evaluating the performance of their responsibilities and duties during their tenure to be submitted to the competent authority. The report should address aspects such as moral qualities, lifestyle, organizational discipline, internal solidarity; work capacity and the results of performed responsibilities and duties; indicating clearly specific achieved products, work achievements, limitations, shortcomings, violations (if any).
- Organize a key personnel conference to gather opinions and conduct a confidence vote by secret ballot regarding the personnel proposed for reappointment.
Composition: Standing Board of the Communist Party of Vietnam Committee, collective leadership of the investigating agencies; Heads and Deputy Heads of departments and equivalents; Senior Investigators and equivalents, Intermediate Investigators and equivalents; Heads of mass organizations in the investigating agencies.
- The leadership of the investigating agencies shall provide comments, evaluations, and propose the reappointment.
- The collective leadership and the Standing Board of the Communist Party of Vietnam Committee of the investigating agencies shall hold a secret ballot to agree or disagree with the reappointment of the personnel under consideration.
Principle of introduction: Personnel receiving over 50% approval from the summoned attendees at conferences (conferences in Clause 2, 4, Article 12 of Circular 01/2024/TT-VKSTC) shall be submitted to the competent authority for reappointment consideration. In cases where the approval rate reaches 50% (a simple majority) of the summoned attendees, the decision shall be taken by the head; if the approval rate is below 50%, a full report with different opinions shall be submitted to the competent authority for consideration and decision.
- The Standing Board of the Communist Party of Vietnam Committee and the collective leadership of the investigating agencies, through the Personnel Department, shall report to the leadership of the Supreme People's Procuracy responsible for the unit before reporting to the Party Civil Affairs Committee, and the Prosecutor General of the Supreme People's Procuracy to issue a reappointment decision.
