On July 31, 2024, the Ministry of Industry and Trade of Vietnam promulgated Decision 2017/QD-BCT regarding the announcement of newly issued and amended administrative procedures related to protection of consumers’ rights under the management of the Ministry of Industry and Trade of Vietnam.
The Ministry of Industry and Trade of Vietnam has announced the regulation on the procedures for notifying the acts of selling goods at locations other than regular transaction locations at the commune level in Vietnam with the following steps:
- Business organizations or individuals must notify the commune-level People's Committee where the products, goods are sold, or services are provided.
- The notification dossier must be sent to the commune-level People's Committee at least 03 working days before the activity is carried out (based on the date recorded by the commune-level People's Committee on the postal receipt or equivalent forms in the case of mail submission, based on the date recorded on the receipt of the dossier in the case of direct submission, based on the time recorded on the email system or based on the date recorded on the system in the case of online public service system submission).
- In the case of amending or supplementing the content of activities already notified to the commune-level People's Committee, the business organization or individual must notify the amended or supplemented content to the commune-level People's Committee where the notification was previously made.
The commune-level People's Committee shall publicly disclose the full content of the notification by business organizations or individuals in an appropriate manner for consumers in the locality to know. This disclosure must be made prior to and during the time when the business organization or individual is conducting sales and providing services in the area.
The methods of implementing the above procedure include:
- Via postal mail;
- Directly at the office of the commune-level People's Committee;
- Via email with a digital signature or attached scanned notification with the signature and seal of the business organization or individual to the email address published by the commune-level People's Committee;
- Using the online public service system provided by the commune-level People's Committee.
