On July 30, 2024, the Government of Vietnam issued Decree 102/2024/ND-CP providing guidance on the Land Law 2024, including the procedures for land use extension in Vietnam when the land use term expires from August 1, 2024

Procedures for land use extension in Vietnam when the land use term expires from August 1, 2024

Within the timeframe stipulated in Clause 3, Article 172 of the Land Law 2024, land users who wish to extend their land use rights when the land use term expires must submit one (01) set of application documents for the extension at the dossier-receiving and result-delivering agency as prescribed in Clause 1, Article 12 of Decree 102/2024/ND-CP. The dossier includes an application form for land use extension according to Form No. 08 in the Appendix issued together with Decree 102/2024/ND-CP and one of the following documents:

- One of the certificates stipulated in Clause 21, Article 3, Clause 3, Article 256 of the Land Law 2024;

- Decision on land allotment, decision on land lease, decision permitting the change of land use purpose by a competent state agency as per land laws over different periods;

- Document from a competent authority permitting the extension of the project operation period or indicating the project operation period according to investment laws concerning land use for project execution.

The order and procedures for extending land use rights are carried out in accordance with Clauses 2, 3, 4, and 6, Article 44 of Decree 102/2024/ND-CP. The content of the decision for the land use extension follows Form No. 04e in the Appendix issued together with Decree 102/2024/ND-CP. In cases where the land user does not request a new Certificate, the Land Registration Office or its branch shall record the change in the land use term on the previously issued certificate, and transfer it to the dossier-receiving and result-delivering agency as stipulated at Point a, Clause 1, Article 12 of Decree 102/2024/ND-CP for delivery to the land user.
