Procedures for handling aircraft violating Vietnam's airspace from December 9, 2024

On October 24, 2024, the Government of Vietnam promulgated Decree 139/2024/ND-CP stipulating the format for intercepting, escorting, and compelling aircraft violating Vietnam's airspace to land at airports and airfields.

Procedures for handling aircraft violating Vietnam's airspace from December 9, 2024

The procedures for handling aircraft violating Vietnam's airspace is stipulated as follows:

- The airspace management and flight operations management agency under the Air Defense - Air Force when detecting or receiving information about aircraft violating Vietnam's airspace

+ Timely report to their commanding officer, the superior command headquarters, and notify civilian aviation flight management units and relevant coordination agencies and units;

+ Upon orders from the Minister of National Defense, the Air Force shall execute intercept flights, escort flights, or force landings of aircraft violating Vietnam's airspace at airports or airfields as specified;

+ If receiving information about aircraft violating Vietnam's airspace from the Navy, Military Regions, or civilian air traffic management facilities, information must be verified before proceeding with the outlined processing steps.

- The civilian aviation flight operations facility at the airport or airfield where the violating aircraft has landed

In cases where intercept flights, escort flights, or forced landings are deployed for aircraft violating Vietnam's airspace landing at designated airports, the civilian aviation flight operations facility shall perform the following duties:

+ Coordinate with relevant military units during the execution of intercept flights, escort flights, or forced landings of violating aircraft landing at airports or airfields;

+ Establish communication with the unit commanding intercept flights, escort flights, or forced landings; maintain two-way communication with intercepting, escorting, or forcing aircraft and provide them with known information related to the violating aircraft;

+ Notify the adjacent flight operations facility if the violating aircraft enters the responsibility area of this flight operations facility;

+ After the violating aircraft safely lands at the designated airport or airfield, the flight operations facility shall guide the violating aircraft to taxi to the parking position.

More details can be found in Decree 139/2024/ND-CP which comes into force in Vietnam from December 9, 2024.
