On October 31, 2024, the Minister of Education and Training of Vietnam issued Decision 3278/QD-BGDDT announcing the amendments and supplements to administrative procedures in the field of education and training with foreign countries under the management scope and function of the Ministry of Education and Training.
The procedures for establishing a representative office of foreign educational institutions in Vietnam is as follows:
- Step 1: The foreign educational institution applying for permission to establish a representative office in Vietnam submits the application dossier to the Ministry of Education and Training.
- Step 2: Within 5 working days from the date of receiving sufficient application dossiers as prescribed, the Ministry of Education and Training will send the dossier for opinions from relevant agencies, units, and localities. The agency, unit, or locality asked to provide opinions is responsible for responding in writing within 15 working days from the date of receiving the request for opinions.
Within 5 working days from the date of receiving opinions from the relevant agencies, units, and localities, the Ministry of Education and Training shall decide whether to permit the establishment of the foreign educational representative office according to Form No. 19 in the Appendix issued together with Decree 86/2018/ND-CP. In the case of non-approval, the receiving agency must provide a written response clearly stating the reason.
In case of incomplete dossiers, within 5 working days, the receiving agency shall notify in writing directly or via postal service, electronic mail to the foreign educational institution for notification and supplementary submission.
The foreign educational institution submits the application directly to the Ministry of Education and Training, through postal service or the online public service portal.
Conditions for establishing a representative office of a foreign educational institution in Vietnam
- Have legal status.
- Have been operating for at least 5 years in the home country with accredited educational quality or recognized by a competent authority for educational quality.
- Have clear regulations, principles, and purposes of operation.
- Have regulations on the organization and operation of the proposed representative office to be established in Vietnam in accordance with Vietnamese law.
- Have a legal office location and ensure order, safety, and labor hygiene as prescribed by law.
