Procedures for establishing a provincial association in Vietnam from November 26, 2024

On November 5, 2024, the Minister of Home Affairs of Vietnam issued Decision 780/QD-BNV on the publication of administrative procedures prescribed in Decree 126/2024/ND-CP regarding the organization, operations, and management of associations in Vietnam.

Procedures for establishing a provincial association in Vietnam from November 26, 2024

The details of the procedure for establishing a provincial association in Vietnam from November 26, 2024, are as follows:

(1) Procedures

- Step 1: The organizing committee for establishing the association, which operates within the province, submits the application for establishment to the Provincial People's Committee (Department of Home Affairs).

- Step 2: The official receiving the application reviews the documents and requests additional documents if the application is incomplete or not legal. If the application is refused, the reason for refusal must be clearly stated.

- Step 3: From the date of receiving a complete and legal application, the Department of Home Affairs researches, appraises the application for permission to establish the association, and conducts the process of gathering opinions from relevant agencies, compiling feedback, and requesting supplementary documents (if any).

- Step 4: The Chairman of the Provincial People's Committee considers and decides whether to permit the establishment of the association. If not agreed, a written response must be provided, clearly stating the reasons.

(2) Method of Implementation

Submit the application directly at the Provincial People's Committee (Department of Home Affairs); via public postal services or through the Online Public Service Portal. The application must have a document receipt confirmation from the competent authority. If sent via public postal services, the date of receipt is based on the postmark date.

(3) Composition and Quantity of Documents

* Document components:

- Application for establishing an association (as per the template);

- Draft charter of the association (as per the template);

- Decision recognizing the organizing committee for establishing the association, accompanied by a list of members of the organizing committee (original);

- List and registration form for participation in establishing the association by organizations, Vietnamese citizens registering to participate (original);

- Personal profile résumé as per the template and judicial record card number 1 (original) of the head of the organizing committee not exceeding 06 months to the date of application submission;

- Written consent from the competent authority following regulations on staff management for officials and public employees participating as the head of the organizing committee (original);

- Documentation proving lawful use rights of the proposed association headquarters location as per legal regulations (original or certified copy);

- Asset declaration form for establishing the association (original) voluntarily contributed by the organizing committee (if any);

- Commitment to secure operational funding for the first term of the association if established (original).

* Number of document sets: 01 set (original).

(4) Processing Time

60 working days from the date the Provincial People's Committee (Department of Home Affairs) receives the complete and lawful application.

(5) Target Entities for Administrative Procedures

Associations operating within the province.

(6) Administrative Authority

Provincial People's Committee (Department of Home Affairs).

(7) Result of Administrative Procedure

Decision permitting the establishment of the association.

(8) Fee: None.

More details can be found in Decision 780/QD-BNV (effective from November 26, 2024), which abolishes previously announced administrative procedures made public at Decision 579/QD-BNV dated July 15, 2015.
