The procedure for establishing a national technology exchange in Vietnam is outlined in Decision 1919/QD-BKHCN dated August 28, 2023, announcing the internal administrative procedures within the state administrative system under the management of the Ministry of Science and Technology of Vietnam.
The procedures for establishing a national technology exchange in Vietnam are as follows:
- The agency or organization proposing the establishment of a national technology exchange must prepare 02 (two) sets of application dossiers and send them directly or by post to the Ministry of Science and Technology (MOST).
- Within 05 working days from the date of receipt of the application, the MOST shall check the validity of the dossier. If the dossier is not valid, the competent authority shall notify in writing to the organization preparing the dossier to amend or supplement it.
- Within 30 days from the date of receipt of a complete and valid dossier, the MOST must provide its appraisal opinion.
- Within 15 working days from the date of appraisal opinion, the MOST shall consider and decide on the establishment. If the establishment of the national technology exchange is not approved, the MOST shall send a written notification to the organization or individual, stating the reasons.
The requirements and conditions for the procedure of establishing a national technology exchange in Vietnam are as follows:
- Conditions on human resources:
+ At least 05 people with a university degree or higher, of which at least 40% are official employees, 30% have certificates or certification of completion of courses on: consulting, brokerage, technology transfer promotion; intellectual property asset management; technology assessment and valuation; intellectual property asset valuation;
+ The head must have a university degree or higher, hold certificates or certification of completion of courses on one of the skills specified in Point a, Clause 1, Article 5 of Circular 16/2014/TT-BKHCN, and have at least 03 years of experience in technology commercialization and intellectual property assets.
- Conditions on physical and technical facilities for the national technology exchange:
+ Having the right to use a minimum area of 1000m2 for a period of 05 years or more for the purposes of introducing, consulting, negotiating technology transfer, intellectual property assets, and other activities serving the functions of the technology exchange;
+ Having a database or the right to use and exploit databases on the supply and demand of technology and intellectual property assets; about organizations and individuals brokering technology; organizations and experts assessing and valuing technology and intellectual property assets; organizations and experts supporting technical, consulting technology transfer, intellectual property ownership, standards, measurement, quality;
+ Having technical processes and management processes for technology and intellectual property asset transactions to ensure the rights and interests of organizations and individuals participating in technology and intellectual property asset transactions;
+ Having a separate website or the right to use a common website on technology and intellectual property asset transactions;
+ Having an electronic transaction board and technical measures to ensure that parties conduct technology and intellectual property asset transactions and update information on technology and intellectual property asset transactions.
