Procedures for determining and issuing electricity generation price range of solar power plants and wind power plants in Vietnam

- Before November 1 every year, Vietnam Electricity (EVN) shall: 

+ Propose the selection of the standard solar power plant or standard wind power plant to determine the electricity generation price range. 

+ Calculate or hire consultants to select the specifications and calculate and determine the electricity generation price range of the standard solar power plant and standard wind power plant according to Chapter II of Circular No. 19/2023/TT-BCT.

+ Prepare documents on calculating the electricity generation price range of the ground-mounted solar power plant, floating solar power plant, onshore wind power plant, offshore wind power plant, and wind power plant at sea for the following year according to Article 1 of Circular No. 19/2023/TT-BCT for presentation to the Electricity Regulatory Authority of Vietnam for appraisal.

- Within 5 working days from the date on which documents on calculating electricity generation price range under Article 11 of Circular No. 19/2023/TT-BCT are received, the Electricity Regulatory Authority of Vietnam shall inspect such documents for their contents, adequacy, and legitimacy. In necessary cases, the Electricity Regulatory Authority of Vietnam shall request the EVN in writing to provide amendments, additions, or explanations for the contents of the mentioned documents. 

Within 15 working days from the date on which the requests for amendments, additions, or explanations for the contents of the related documents from the Electricity Regulatory Authority of Vietnam are received, the EVN shall provide reports and explanations for the contents of the related documents as requested.  

- In case of receiving valid applications and reports on explanations for contents in the documents from the EVN, within 20 working days from the date on which the mentioned documents are received, the Electricity Regulatory Authority of Vietnam shall appraise the electricity generation price range presented by the EVN. 

If necessary, the Electricity Regulatory Authority of Vietnam shall collect feedback pertaining to the price range from a Board of Counsel established by the Ministry of Industry and Trade of Vietnam or from the impacted subject.  The Board of counsel has up to 9 members, including a Chairperson, a Vice Chairperson, a Secretary, and representatives of relevant entities of Ministry of Industry and Trade of Vietnam with sufficient specialty and comprehensive understanding in electricity generation.

- Within 15 working days from the date of appraisal of the electricity generation price range, the Electricity Regulatory Authority of Vietnam shall appeal to the Minister of Industry and Trade for the approval of the electricity generation price range applicable to ground-mounted solar power plants, floating solar power plants, onshore wind power plants, offshore wind power plants, and wind power plants at sea for the following year and disclose the information on its website. 

If the electricity generation price range of the following year has yet to be disclosed, it is permitted to temporarily use the most recent electricity generation price range.
