Procedures for changing forest use purpose in Nghe An and Thanh Hoa, Vietnam

Accordingly, the procedures for conversion of forest use purpose to other purposes of People's Council of Thanh Hoa province, Nghe An, Vietnam province under the authorization of the Prime Minister are prescribed as follows:

- The organizations or individuals requesting the forest repurposing shall send 01 dossier specified in the Decision No. 14/2022/QD-TTg directly or by post or electronically to the Department of Agriculture and Rural Development;

- If the dossier is invalid, within 3 working days after receiving the dossier, the provincial/municipal Agriculture and Rural Development Service shall guide directly or reply in writing the organization or individual that has requested the change of the forest use purpose.

Within 15 working days after receiving complete and valid dossiers, the provincial Department of Agriculture and Rural Development and organizations and individuals wishing to change the forest use purpose shall publicly post them up and gather opinions of forest owners and communities where forests exist and report them to the provincial-level People's Committee.

- Within 30 working days from the day on which the satisfactory application is received, the People's Committee of the province shall carry out the appraisal of the forest repurposing policy.

- Within 10 working days from the day on which the appraisal results are available, People's Committees of provinces shall consolidate and submit them to People's Councils of provinces for deciding the forest repurposing policy.

- The provincial People's Councils shall consider and decide the policy to convert forest use purpose to other purposes in accordance with law provisions and the working regulations of the provincial People's Councils.

The Decision No. 14/2022/QD-TTg comes into force from the date on which it is signed and is pilot to the date of entry into force of the Resolution No. 36/2021/QH15 dated November 13, 2021 and the Resolution No. 37/2021/QH15 dated November 13, 2021.
