Procedures and content for review and issuance of construction permits in Vietnam

The procedures and content for review and issuance of construction permits in Vietnam are as follows:

- Procedures for issuing a construction permit:

+ The authority issuing the construction permit conducts an inspection, evaluates the dossier, and issues the construction permit according to the procedure stipulated in Article 102 of the Construction Law 2014, as amended and supplemented by Clause 36 Article 1 of Law No. 62/2020/QH14;

+ No later than 5 days from the date of receipt of complete and valid dossiers, the competent authority must issue a written request for opinions of the state management body on relevant fields concerning the construction works if the dossier lacks complete or consistent information;

+ The construction permit authority uses its agency's electronic signature or the seal template as prescribed in Form No. 12 Appendix II of Decree 175/2024/ND-CP to stamp the verification seal on the design drawings accompanying the construction permit issued to the investor.

- The authority issuing the construction permit is responsible for checking the conditions for issuing construction permits as stipulated in Article 50 of Decree 175/2024/ND-CP. The inspection of contents already appraised, approved, or verified by the relevant bodies or organizations is conducted as follows:

+ Verify the compliance of the construction design drawings in the application dossier with the basic design appraised and stamped by the specialized construction agency for projects requiring feasibility study report appraisal at the specialized construction agency; check the implementation, supplementation, and completion of the dossier as required by the specialized construction agency in the feasibility study report appraisal notification (if any), and the construction design implemented after the basic design (if any);

+ Check the compliance of the construction design drawings in the application dossier with the fire safety verified construction design drawings by the competent authority for construction works subject to fire safety verification requirements;

+ Verify the completeness and validity of the appraisal report for construction projects requiring design verification according to the provisions of Decree 175/2024/ND-CP.
