Procedure for Handling Administrative Violations by the Border Guard Forces

On June 08, 2016, the Ministry of National Defense issued Circular 78/2016/TT-BQP stipulating the procedure for handling administrative violations (VPHC) by the Border Guard.

The competent authority handling administrative violations in the Border Defense Force who is performing official duties has the right to issue on-the-spot penalties for the following cases:

- Administrative violations with sanctions of a warning or a fine up to VND 250,000 for individuals and up to VND 500,000 for organizations;- Multiple administrative violations where the sanction for each violation is a warning or a fine up to VND 250,000 for individuals and up to VND 500,000 for organizations;- For administrative violations detected through technical and professional means and equipment, a record of the administrative violation shall be made, and penalties shall be imposed according to procedures with recording.

Fines shall be paid immediately on the spot; if it is not possible to pay fines immediately on the spot, payment shall be made at the state treasury or at a bank authorized by the treasury to collect.

Circular 78/2016/TT-BQP takes effect from August 01, 2016.
