On July 1, 2024, the Chief Inspector of the Government of Vietnam promulgated Circular 06/2024/TT-TTCP stipulating the establishment and management of case files on inspection, complaint settlement, and denunciation settlement in Vietnam.
The person resolving the complaint is responsible for organizing and directing the filing of the case files on settlement of denunciations in Vietnam.
In case the person resolving the complaint assigns the same-level inspection authority or other authorities, organizations, units, or individuals to verify the complaint content, the Head of the authority, organization, or unit presiding over the verification, or the Head of the Verification Team, Team Leader, the person assigned the verification task is responsible for assisting the person resolving the complaint in filing the case files on settlement of denunciations.
Specifically, the procedure for filing case files on settlement of denunciations is as follows:
Step 1: File case file
- The case file is opened from the date the authorized person issues the decision to admit the complaint;- Based on the decision to admit the complaint, the person assigned to file the case file will open and update the initial information in the case file.
Step 2: Collect and update documents and materials into the case file
- The person assigned to file the case file has the responsibility to collect and update documents and materials during the complaint resolution process into the opened case file, ensuring the accuracy, integrity, system, and completeness of the case file;
- Documents in the case file must be arranged into groups as regulated in Article 15 of Circular 06/2024/TT-TTCP.
Step 3: Close the case file
- The case file is closed on the last day when the disclosure of the complaint content conclusion ends, the authorized person notifies the complainant of the complaint resolution result and discloses the decision on handling the violation action if any;
- The person assigned to file the case file is responsible for reviewing all documents and materials in the case file; removing duplicates and drafts from the case file; adjusting the title, number, and sign of the case file appropriately; completing and closing the case file.
