On February 11, 2025, the Ministry of Natural Resources and Environment issued Decision 395/QD-BTNMT regarding replacing internal administrative procedures in the state administrative system under the management functions of the Ministry of Natural Resources and Environment.

Procedure for developing, adjusting, appraising, deciding, and approving the national land use plan in Vietnam

* Implementation Sequence

- Step 1:

The Ministry of Natural Resources and Environment submits to the Prime Minister of the Government of Vietnam to establish and adjust the Appraisal Council for the national land use plan.

- Step 2:

The Ministry of Natural Resources and Environment sends the dossier of the national land use plan, adjustments to the national land use plan to the members of the Appraisal Council for their opinion.

- Step 3: Collecting opinions on the national land use plan, adjustments to the national land use plan is done according to the following regulations:

(1) The subjects whose opinions are sought regarding the national land use plan, adjustments to the national land use plan include the Central Committee of the Vietnam Fatherland Front, ministries, ministerial-level agencies, and People's Committees at the provincial level.

(2) The content of the draft national land use plan, adjustments to the national land use plan is open for opinions, except for content related to state secrets as prescribed by law.

(3) The collection of opinions from the Central Committee of the Vietnam Fatherland Front, ministries, ministerial-level agencies, and relevant provincial People's Committees on the national land use plan, adjustments to the national land use plan is implemented as follows:

+ The agency developing, adjusting the national land use plan sends the dossier of the national land use plan, adjustments to the national land use plan to solicit opinions;

+ The consulted agencies are responsible for responding in writing within 30 days from the date of receipt of the dossier on the national land use plan, adjustments to the national land use plan.

(4). The agency developing, adjusting the national land use plan is responsible for aggregating, accepting, and explaining opinions before submitting for appraisal of the national land use plan, adjustments to the national land use plan.

- Step 4:

Within no more than 15 days from the date of receiving valid dossiers, members of the Appraisal Council for the national land use plan, adjustments to the national land use plan send written opinions to the Ministry of Natural Resources and Environment.

- Step 5:

After collecting feedback, the Chairman of the Council organizes a meeting of the Appraisal Council for the national land use plan, adjustments to the national land use plan.

- Step 6:

After the Appraisal Council meeting, the Ministry of Natural Resources and Environment completes the dossier of the national land use plan, adjustments to the national land use plan, and submits it to the Government of Vietnam for approval.

* Mode of Implementation:

As prescribed in Circular 29/2024/TT-BTNMT dated December 12, 2024, by the Minister of Natural Resources and Environment, setting forth technical regulations on the development and adjustment of land use planning and plans.

* Component and Number of Dossiers:

- Submission for approval of the national land use plan, adjustments to the national land use plan;

- Explanatory report on the national land use plan, adjustments to the national land use plan;

- Draft Resolution of the Government of Vietnam for the approval of the national land use plan, adjustments to the national land use plan;

- Report aggregating feedback from agencies, organizations, communities, individuals on the national land use plan, adjustments to the national land use plan; copies of feedback from ministries, ministerial-level agencies, and relevant localities; report on the incorporation and explanation of feedback regarding the national land use plan, adjustments to the national land use plan.
