Principles and grounds for determining the position of professional civil servants in the judicial sector in Vietnam

Principles and grounds for determining the position of legal professional civil servants in Vietnam are as follows:

- The position of legal professional civil servant is determined on the basis of the principles specified in Article 3 of Decree 62/2020/ND-CP:

+ Complying with the Party's regulations and the law on employment positions, management, and use of civil servant payrolls.

+ In accordance with the functions, tasks, powers, and organizational structure of the agency or organization.

+ Ensuring consistency and synchronization between determining job positions, the structure of civil servant ranks, and using and managing civil servant payrolls.

+ Ensuring scientific, objective, public, transparent, democratic, and practicality.

+ Associating payroll reduction with restructuring and improving the quality of civil servants in agencies and organizations.

- The basis for determining the position of a professional civil servant working in the Judiciary sector shall comply with the provisions of Clause 1, Article 4 of Decree 62/2020/ND-CP:

+ Functions, tasks, powers, and organizational structure of agencies and organizations;

+ Complexity, nature, characteristics, and scale of operations; scope and object of service; professional and professional management processes in accordance with specialized laws.

The list of job positions, job description, and competency framework for the legal professional civil servant job position are as follows:

- The list of professional civil servant positions in the Judiciary sector is specified in Appendix I to Circular 02/2023/TT-BTP.

- The job description and competency framework for the position of legal professional civil servant are specified in Appendix II, III, IV, V, VI, VII, VIII, and IX attached to Circular 02/2023/TT-BTP.

- The framework for determining the capacity requirements for professional civil servant positions in the judicial sector is specified in Appendix X attached to Circular 02/2023/TT-BTP.
