Plan to settle Compulsory Social Insurance Benefit for the Deputy Chief of the Commune Police in Vietnam

Recently, Vietnam Social Security has Official Letter 881/BHXH-CSXH on solving problems in implementing compulsory social insurance for Deputy Military Commander Commune, Deputy Chief of Commune Police and people working under employment contracts at commune-level People's Committees.

In this Official Dispatch, the Vietnam Social Security proposes a unique solution to the compulsory social insurance regime for the Deputy Commander of the Commune Military, the Deputy Head of the Commune Police and those working under the Employment Contract at the Commune People's Committee, which is Plan 1 mentioned in Report 6765/TTr-BNV dated December 23, 2020, of the Ministry of Home Affairs of Vietnam, specifically:

- For the position of Deputy Commander of the Commune-level Military and Deputy Chief of the Commune-level Public Security Office, who have worked from November 2003 to present, if they have paid compulsory social insurance: They are entitled to enjoy social insurance benefits under the provisions of Vietnam's Law on Social Insurance when they are fully qualified or have the time to have paid for compulsory social insurance in accordance with the provisions of Vietnam's Law on Social Insurance.

- For employees whose labor contracts are signed by the commune-level People's Committees for a full 03 months or more, who have paid compulsory social insurance and whose salary as the basis for payment is the salary stated in the labor contract according to the salary regime decided by the employer: They are entitled to enjoy social insurance benefits if they are eligible or reserve the time after they have paid compulsory social insurance as prescribed.
