Plan for drafting and issuing guidelines for the 2022 Law on Prevention and Combat against Domestic Violence in Vietnam

The plan for drafting and issuing guidelines for the 2022 Law on Prevention and Combat against Domestic Violence is as follows:

- Drafting a Decree detailing certain articles of the 2022 Law on Prevention and Combat against Domestic Violence (The Government of Vietnam issued Decree 76/2023/ND-CP on November 1, 2023).

- Drafting a Decree on the Database for Domestic Violence Prevention and Control

+ Lead agency: Ministry of Culture, Sports and Tourism.

+ Coordinating agencies: Ministry of Public Security, Ministry of Justice, Ministry of Health, Office of the Government of Vietnam, Vietnam Social Security, and other relevant agencies and organizations.

+ Submission deadline: Before October 15, 2024.

- Drafting a Decree amending and supplementing certain articles of Decree 144/2021/ND-CP on administrative sanctions in security, order, social safety; social evils prevention; fire prevention and fighting; rescue operations; and domestic violence prevention, related to the handling of administrative violations under the 2022 Law on Prevention and Combat against Domestic Violence.

+ Lead agency: Ministry of Public Security.

+ Coordinating agencies: Ministry of Culture, Sports and Tourism, Ministry of Justice, Office of the Government of Vietnam, and other relevant agencies and organizations.

+ Submission deadline: Before December 15, 2024.

- Ministers and heads of equivalent agencies shall review the regulations of the Law and related legal documents within their assigned tasks and powers to issue, or submit for issuance, legal documents ensuring coherence and uniformity of legal regulations.

Plan for reviewing regulations related to the 2022 Law on Prevention and Combat against Domestic Violence in Vietnam

- Content: Review the legal documents related to the 2022 Law on Prevention and Combat against Domestic Violence within the scope of assigned state management; promptly amend, supplement, replace, repeal or issue new legal documents in accordance with the 2022 Law on Prevention and Combat against Domestic Violence and the Decrees detailing certain articles of the Law.

- Implementing agencies: The Ministry of Culture, Sports and Tourism will review legal documents related to the 2022 Law on Prevention and Combat against Domestic Violence within its scope of state management. Ministries, equivalent agencies, and People’s Committees of provinces and centrally-administered cities will review legal documents related to the 2022 Law on Prevention and Combat against Domestic Violence within their areas of state management and send the review results to the Ministry of Culture, Sports and Tourism for consolidation and reporting to the Prime Minister of the Government of Vietnam.

- Completion time: December 2024.
