Pilot urban development model toward Transit Oriented Development (TOD) in Vietnam

- The City People's Council decides to use the local budget to implement independent public investment projects for compensation, support, and resettlement for investment projects under separate urban design projects, urban planning projects in the vicinity of railway stations, approved by competent authorities, and in the vicinity of traffic intersections along Ring Road 3 in the city's territory to acquire land, embellish and develop urban areas, carry out resettlement, and create a land fund for auction to select investors for investment projects in urban development, commerce, and services in accordance with the provisions of the law;

- Authority, order, and procedures for investment and construction for compensation, support, and resettlement projects specified at Point a of this Clause shall be implemented according to the authority, order, and procedures of group A public investment projects according to the criteria prescribed by the law on public investment;

- For the vicinity of stations and intersections specified at Point a of this Clause, the City People's Committee may decide to adjust construction density, technical and social infrastructure criteria compared with the provisions of the national technical regulation on construction planning for existing urban areas, but must ensure the satisfaction of technical and social infrastructure systems and the architectural planning criteria are determined in the content of the zoning planning project, the city's general plan;

- The land recovery for the projects specified at point a of this clause must fully satisfy the following conditions: the project has been approved by the investment policy and belongs to the city's medium-term public investment plan; the location, boundary, and recovered land area of the project in the vicinity have been determined in the urban planning project, separate urban design project, land use planning, and district annual land use plan.

Resolution 98/2023/QH15 takes effect from August 1, 2023.
