Pilot implementation of specific policies on investment in road construction projects in Vietnam

On January 27, 2024, the Government issued Resolution 16/NQ-CP to implement Resolution 106/2023/QH15 dated November 28, 2023, by the National Assembly, piloting specific policies on investment in road infrastructure construction in Vietnam.

The People's Committees of Thai Binh and Cao Bang provinces are responsible for submitting to the competent authorities for consideration and decision on adjustments to the investment policies of the projects in accordance with the provisions set forth in Appendix I of Resolution 106/2023/QH15.

The establishment, appraisal, and approval of adjustments to investment policies and the deployment of projects shall be conducted in accordance with current regulations.

Furthermore, the People's Committees of the provinces assigned as the managing agencies for road construction projects under Article 3 of Resolution 106/2023/QH15 are required, prior to February 15, 2024, to submit proposals to the Ministry of Planning and Investment designating the managing agencies. This is to compile and present to the Prime Minister a special decision allowing the Provincial People's Committees to act as the managing agencies, utilizing local budgets and other lawful capital sources to invest in national highway and expressway projects as specified in Appendix II of Resolution 106/2023/QH15; and to delegate a Provincial People's Committee as the managing agency, using this local budget to support other localities in implementing public investment activities for projects listed in Appendix III of Resolution 106/2023/QH15.

Ensure the operational capacity of agencies and organizations and the professional capacity of individuals involved in project implementation in accordance with the legal regulations on construction as committed.

Allocate the entire capital plan to implement the projects as regulated to complete the projects and project components on schedule as committed. In the event of factors that increase the scale and total investment capital of the project, the locality is responsible for allocating local budget funds and other lawful capital sources (for the additional increase) to deploy and complete the project on the committed schedule.

Take responsibility for the management, exploitation, and maintenance of the roadways during the investment process of upgrading and expanding.

For projects listed in Appendix II and Appendix III of Resolution 106/2023/QH15 that do not have sufficient investment procedures, once assigned by the Prime Minister as the managing agency as stipulated above, the localities shall complete the investment procedures within the effective period of Resolution 106/2023/QH15.

Carry out the functions and tasks assigned in accordance with the Law on Public Investment, the Law on Construction, and related legal regulations; perform the functions and tasks of the agency assigned as the managing agency for project investment; inspect, supervise, and audit to ensure that there is no exploitation of policies for personal gain, group interests, loss, or waste; and take responsibility for proposing to the Prime Minister the decision to assign the Provincial People's Committee as the managing agency.
