Only return to the working position after the conclusion of non-corruption

This is a notable content in Decree 134/2021/ND-CP amending and supplementing Decree 59/2019/ND-CP detailing a number of articles and measures to implement the Law on Anti-corruption.

Accordingly, amending regulations on restoring legitimate rights and interests of persons with positions and powers after competent agencies or organizations conclude that such persons have not committed corrupt acts as follows:

Persons who are temporarily suspended from work or temporarily transferred to another working position may return to their original working position after a competent agency or organization concludes that such person has not committed corrupt acts ; may apologize, make public corrections and be compensated for damage caused by illegal acts in making decisions on temporary suspension of work or temporary transfer to another job position in accordance with law.

(Previously, people who were suspended from work or temporarily transferred to another job position could return to their original working position after a competent agency or organization concluded that such person did not commit corrupt acts. or at the end of the suspension period, temporarily transfer to another working position without any conclusion on corrupt acts).

Thus, Decree 134/2021 has removed the regulation on restoring the original working position in case the suspension period expires, temporarily changing to another working position without any conclusion on corrupt acts.

Decree 134/2021/ND-CP takes effect from February 15, 2022.
