Below is the content of the Circular 41/2023/TT-BCA dated August 25 /2023 on implementation of allowance regime for People's Public Security officers and soldiers participating in the resistance war against the US with less than 20 years of service in the People's Police who have quit their jobs and returned to their localities in Vietnam issued by the Minister of Public Security.

Lump-sum allowance for People's Public Security soldiers who participated in the anti-American war and have been demobilized for less than 20 years in Vietnam

Lump-sum allowance for officers and soldiers of the People's Public Security participating in the resistance war against the US with less than 20 years of service in the People's Police who have quit their jobs and returned to their localities as follows:

-  Officers and soldiers specified in Point a, Clause 1, Article 2 of Circular 41/2023/TT-BCA (except for the cases specified in Clause 3, Article 3 of CCircular 41/2023/TT-BCA) in one of the following cases are entitled to a Lump-sum allowance:

+ Have a working period of less than 15 years;

+ Have a working period of less than 15 years; after quitting the job, demobilize and return to the locality to continue working in communes, wards, or towns that participate in mandatory or voluntary social insurance but are not eligible for a monthly pension according to the provisions of the law on social insurance;

+ Have a working period of less than 20 years; after quitting the job, demobilize and return to the locality to work in communes, wards, and towns; receive salary from the state budget; participate in mandatory social insurance; and be eligible to receive monthly benefits or a monthly pension. according to the provisions of the law on social insurance.

- How to calculate benefits:

+ Lump-sum allowance is calculated according to the number of years of work for which benefits are calculated, specifically: From full 02 years (24 months) or less, the Lump-sum allowance is equal to 2,500,000 VND; from the 3rd year onwards, each year the Lump-sum subsidy is increased by 800,000 VND.

+ The Lump-sum subsidy is calculated according to the formula:

Benefit level = 2,500,000 VND + [(number of years of work to be considered for benefits - 2 years) x 800,000 VND/year)]

+ In case officers and soldiers specified in Clause 1, Article 5 of Circular 41/2023/TT-BCA die after October 15, 2010 but have not yet received a lump-sum allowance, one of the following people: the deceased person's spouse, biological father, biological mother, biological child, adopted child, or legal guardian will receive a lump-sum benefit in arrears.

- If Officers and soldiers specified in Point a, Clause 1, Article 2 of Circular 41/2023/TT-BCA (except for the cases specified in Clause 3, Article 3 of Circular 41/2023/TT-BCA) died before October 15, 2010, one of the following people: spouse, biological father, biological mother, biological child, adopted child, or legal caregiver of the deceased person will receive a Lump-sum allowance of 3,600,000 VND.
