Non-payment for Expired HIV Drugs Due to Health Facility Errors

The Ministry of Health promulgates Circular 28/2017/TT-BYT stipulating the management of HIV drugs as follows:

- On a monthly basis, the healthcare facility (CSYT) must compile statistics on the quantity of medication used at the facility, the quantity of medication currently in stock, and the expiration dates of the stock;- In cases where the quantity of medication in stock is either surplus or insufficient compared to treatment needs, or the medication has an expiration date of less than 6 months, the CSYT is responsible for sending a document to the Ministry of Health to request medication adjustment;- In cases where the CSYT encounters a sudden medication shortage due to unforeseen events, the CSYT must notify the provincial HIV/AIDS prevention and control agency to facilitate medication redistribution.

Note: The Health Insurance Fund does not cover the following cases:

- Medication loss, damage, expiration due to the fault of the CSYT or contractor;- HIV medication in stock that has been reported to the Ministry of Health for redistribution but no CSYT accepted, leading to expiration.

Circular 28/2017/TT-BYT takes effect from August 15, 2017.
