The noteworthy content mentioned in Decree No. 37/2018/ND-CP stipulates detailed implementation of supervision and education measures for individuals under 18 years of age who have committed crimes but are exempt from criminal responsibility.
Persons under 18 years of age who are exempt from criminal liability and subject to educational measures at the commune level (village, neighborhood, or commune-level town) have the right to leave their place of residence for legitimate reasons and must declare temporary absence.
- If the absence is less than 15 days, a notification must be made to the person directly supervising them. Subsequently, the direct supervisor must report the absence to the Chairman of the commune-level People's Committee (UBND).- In cases of absence from 15 to 30 days, a request for permission must be submitted to the Chairman of the commune-level People's Committee. The application must be submitted with the opinion of the supervisor and then forwarded to the Chairman of the commune-level People's Committee.
Absences may be taken multiple times, with each absence not exceeding 30 days, and the total absence not exceeding 1/3 of the duration of the supervision and education measures.
