The Minister of Transport of Vietnam issued Circular 23/2023/TT-BGTVT on July 17, 2023, stipulating labor policies and special labor discipline for aviation personnel.

No assignment of aviation personnel in Vietnam who have violated labor discipline within 5 years

Circular 23/2023/TT-BGTVT has stipulated special labor policies for aviation personnel as follows:

- Aviation personnel are subject to special labor policies in accordance with labor laws and civil aviation laws.

- Employers are not permitted to assign an aviation employee who has violated labor discipline or completed a criminal sentence to work in aviation positions within 5 years from the following points:

+ From the effective date of the labor discipline decision for violations specified in points a, d, e, g, clause 2, Article 5 of Circular 23/2023/TT-BGTVT, including:

(i)  Violations  of  regulations  and  labor  rules  causing  incidents,  accidents,  threatening  aviation  safety,  and  security;

(ii)  Theft,  illegal  appropriation  of  organizational  or  individual  property;

(iii)  Exploiting  positions  to  smuggle,  illegally  transport  people,  property,  goods;

(iv)  Using  or  testing  positive  for  drugs  or  other  prohibited  substances;

- From the time of record deletion in a criminal case.

(Currently, Circular 46/2013/TT-BGTVT also stipulates the prohibition on working in any aviation employee position in any enterprise operating in the civil aviation field for the following cases:

- Intentional violations of regulations and rules directly causing aviation accidents or serious aviation incidents.

- Conviction in criminal cases.

- Theft, illegal appropriation of organizational or individual property.

- Exploiting positions to smuggle, illegally transport people, property, goods.

- Using or testing positive for drugs or other prohibited substances.)

Circular 23/2023/TT-BGTVT takes effect from September 1, 2023, and replaces Circular 46/2013/TT-BGTVT.
