On July 18, 2022, the Minister of Information and Communications of Vietnam promulgated Circular No. 10/2022/TT-BTTTT amending Circular No. 13/2018/TT-BTTTT on the list of cyber information security products imported under license and procedures and application for issuance of the license to import cyber information security products.
According to Circular No. 10/2022/TT-BTTTT, the time for re-issuance of licenses to import cyber information security products is shortened as follows:
- Regarding valid Import Licenses that are lost or damaged:
Enterprises shall submit applications for re-issuance of import licenses according to Form No. 2 of Appendix II prescribed in Circular No. 13/2018/TT-BTTTT (amended by Circular No. 10/2022/TT-BTTTT) to the Information Security Department – Ministry of Information and Communications of Vietnam.
- Within 2 working days after receiving valid applications, the Information Security Department - Ministry of Information and Communications of Vietnam shall re-issue Import Licenses for enterprises.
(Compared to current regulations, the time for re-issuance of Import Licenses has been shortened from "3 working days” to “2 working days”)
Additionally, the application for issuance of the license to import cyber information technology products has been simplified as follows:
- An application for issuance of the Import License according to Form No. 1 of Appendix II prescribed in Circular No. 13/2018/TT-BTTTT (amended by Circular No. 10/2022/TT-BTTTT).
- A certified true copy of the certificate or declaration of conformity. If the copy is not certified, the original thereof shall be presented for comparison.
- A Vietnamese or English copy of the technical documentation that describes functionality of the product to be imported.
(Compared to current regulations, the application no longer has the license to conduct the business of cyber information security products and services)
Circular No. 10/2022/TT-BTTTT comes into force as of September 2, 2022.
