New regulation of Vietnam on transitional provisions of contracts for authorized collection of social insurance contributions and health insurance premiums

This is the content of Decision No. 615/QD-BHXH dated April 11, 2023 on amendments to operational regulations of providers of services of collection of social insurance contributions and health insurance premiums promulgated together with Decision No. 1155/QĐ-BHXH dated May 12, 2022 promulgated by Vietnam Social Security.

Amendments to contents of contracts for authorized collection of social insurance contributions and health insurance premiums

Specifically, Decision No. 615/QD-BHXH dated April 11, 2023 has amended contents of service providers in commitments between involved parties in contracts for authorized collection of social insurance contributions and health insurance premiums of Decision No. 1155/QD-BHXH dated May 12, 2022 as follows:

- Comply with regulations of Vietnam Social Security on managing collection, applications, and notifying voluntary payers of social insurance and independent payers of health insurance; regulations on information, reports, inspection, and supervision of social insurance agencies regarding the collection of social insurance contributions and health insurance premiums under contracts.

- Adequately and promptly compensate the damage caused by collectors to social insurance agencies, participants, and relevant parties according to the law.

- Arrange collecting locations in communes, ensuring each collecting location has at least 1 collector.

- Ensure physical and technical facilities, finance, and personnel to implement the development and maintenance of the participation of voluntary payers of social insurance and independent payers of health insurance, specifically:  

+ Encourage people to become voluntary payers of social insurance and independent payers of health insurance.

+ Receive applications and compile lists of voluntary payers of social insurance and independent payers of health insurance.

+ Urge and guide voluntary payers of social insurance and independent payers of health insurance to continue to pay for such insurance to prolong their social insurance participation time recorded and renew their health insurance cards.

+ Collect payment from voluntary payers of social insurance and independent payers of health insurance; adequately and promptly transfer the payment and applications of participants to social insurance agencies.

+ Receive social insurance books and health insurance cards from social insurance agencies and hand them over to voluntary payers of social insurance and independent payers of health insurance.

- Provide refunds of social insurance contributions and health insurance premiums for participants when they are approved by social insurance authorities.

(Previously, each collecting location required main collectors and 3 assistant collectors.)

Transitional provisions of contracts for authorized collection of social insurance contributions and health insurance premiums

Specifically, transitional provisions of contracts for authorized collection of social insurance contributions and health insurance premiums prescribed in Decision No. 615/QD-BHXH dated April 11, 2023 are as follows:

Contracts for authorized collection of social insurance contributions and health insurance premiums (Form No. 02-UQ), according to Decision No. 1155/QD-BHXH dated May 12, 2022, concluded before January 1, 2023, shall continue to be implemented until they expire.
