The Ministry of Finance has just issued Circular 11/2018/TT-BTC amending Circular 77/2014/TT-BTC providing guidelines for Decree 46/2014/ND-CP regulating land rent and water surface rent.

From March 20, 2018, the determination of land rent and water surface rent includes the following noteworthy points:

- In cases where the land use term is extended and the land user (NDSD) is subject to land rent payment, the land rent shall be determined according to the policy and land price at the time of extension.- In cases where the land rent is exempted but the user still wishes to pay, the land rent shall be determined according to the policy and land price at the time the land user submits a written request to pay land rent.- Investors who have paid compensation and site clearance costs according to the provisions of the law before July 1, 2004, and are leased land from July 1, 2004, onwards, shall be deducted the compensated amount for land, land support expenses.

Circular 11/2018/TT-BTC took effect from March 20, 2018.
