New Points of Circulars Effective from July 01, 2018 (Part 2)

Continuing from Part 1, THU KY LUAT respectfully introduces to our esteemed members and customers the new points in Circulars in the fields of healthcare, transportation, and science and technology such as:

  1. Application of New Health Standards for Train Staff

The Ministry of Health issued Circular 12/2018/TT-BYT applying health standards for railway employees directly serving train operations from July 1, 2018, replacing the health standards for railway vehicle operators under Decision 4132/QD-BYT.

Accordingly:

- For the positions of Train Driver; Assistant Train Driver: Must meet health standards in Group 3, Appendix No. 01 of Inter-ministerial Circular 24/2015/TTLT-BYT-BGTVT;

- For the positions of Train Conductor; Yard Master; Station Chief-in-Command; Section Train Dispatcher, Station Train Dispatcher; Signalman; Locomotive and Carriage Connector; Track, Bridge, Tunnel Patrol Staff, Tunnel Guard; Level Crossing and Shared Bridge Guard:

- Must meet health standards of Type II or higher during recruitment examination according to Decision 1613/BYT-QD dated August 15, 1997;- Must meet health standards of Type III or higher during periodic examinations according to Decision 1613/BYT-QD.

  1. Immediate Formation of a Council to Resolve Railway Traffic Accidents

According to the provisions of Circular 23/2018/TT-BGTVT, when a railway traffic accident (TNGT) occurs, an immediate formation of a council to resolve the accident must take place.

The Council's composition includes:

- Leader of the railway infrastructure business enterprise: Chairman of the Council;- Leader of the railway transport business enterprise;- Other related railway enterprises;- Representative of the local People's Committee at the site of the railway traffic accident;- Other related organizations and individuals decided by the person forming the Council.

In case of particularly serious railway traffic accidents on the national railway involving multiple sectors and fields, the national railway infrastructure business enterprise will report to the Ministry of Transport to decide on the formation of an accident resolution council.

  1. Regulations on Information and Signage on Trains

Circular 20/2018/TT-BGTVT sets out several regulations on information and signage on national and specialized railway vehicles as follows:

- The exterior of passenger carriages must display the carriage number plate, and this number must match the one inside the carriage;- Inside the passenger carriages, there must be seat numbers, information boards (in writing or electronic), announcement systems, travel rules, signage for the use of safety and firefighting equipment, prioritized seating, and restrooms;- Signs, information, and instructions must be clear and easy to understand; positioned in easily visible and readable places. Instructional signs for passengers inside the carriage must be displayed in both Vietnamese and English. The broadcasting system must also use Vietnamese and English to guide passengers on the train.

  1. Handling Passengers Who Cannot Purchase Supplementary Train Tickets

This is a noteworthy new point in Circular 09/2018/TT-BGTVT which regulates the transportation of passengers and luggage on national and specialized railways connected to the national railway, officially applied from July 1, 2018.

When an enterprise cannot sell supplementary tickets to passengers due to inability to accommodate, the resolution is as follows:

- Passengers wanting to travel beyond the station indicated on their ticket, those without a ticket, or with an invalid ticket must disembark before the train departs or get off at the nearest station where the train stops, paying the necessary fees as regulated by the enterprise;- Passengers wanting to change from a lower to a higher class will continue using the seat assigned on their ticket.

  1. QCVN 01-186: 2017/BNNPTNT: Requirements for Preserving and Transporting Raw Fresh Milk

QCVN 01-186: 2017/BNNPTNT on raw fresh milk products was issued with Circular 29/2017/TT-BNNPTNT officially applied from July 1, 2018.

Accordingly, the preservation and transportation requirements for raw fresh milk are as follows:

- Preserved at temperatures from 2°C to 6°C using specific equipment and tools for food, which are non-corrosive and non-contaminating; ensuring quality and food safety.- Transported in specific equipment and tools for food that are non-corrosive and non-contaminating; ensuring quality and food safety.
