New guidance on classification of complaints and denunciations in Vietnam

Recently, the Vietnam Government Inspectorate promulgated Circular 05/2021/TT-TTCP dated 01 October 2021 stipulates the process of handling complaints, denunciations, petitions and reflections.

The Circular has added many new regulations in line with reality, especially in the classification of applications as follows:

- Note that the language in the application can use a foreign language. However, the sender must attach a notarized translation in accordance with the law.;

- An anonymous application – an application without the sender's full name and address is eligible for handling if there is a denunciation and clearly state the person committing the violation, have specific documents and evidences about the illegal act, and have grounds for verification and verification in accordance with Clause 2, Article 25 of the current 2018 Law on Denunciations of Vietnam.

In addition, the Circular also adds two cases of invalid applications, including:

- The application contains content opposing the Party's lines and guidelines, and the State's policies and laws; the petition contains the content of division, unity, ethnicity and religion; the application contains profanity, libel, and insults to the honour and reputation of individuals, agencies, organizations and units;

- The application is torn, the writing is erased, unclear, and cannot be read.
