Ministry of Science and Technology of Vietnam’s regulations on state inspection of quality of goods and products 

Circular No. 24/2023/TT-BKHCN stipulates the forms, contents, handling order, and implementation of the state inspection of the quality of goods and products in production under the management of the Ministry of Science and Technology of Vietnam. 

Regulations on forms of state inspection of the quality of goods and products in production are as follows: 

(1) Inspection according to a plan 

- Development of the inspection plan: 

Annually, the inspection authority shall, based on the management requirements and developments in the quality of goods and products, assess compliance with the law on the quality of goods and products and shall, based on the previous inspection results, developments in the budget, and directive of the superior management authority, develop an inspection plan according to Clause 2 Article 47 of the Law on Quality of Products and Goods. The inspection plan shall be approved by a competent authority, and an inspection plan for the following year must be issued no later than November 30 every year.

- Before carrying out the planned inspection, the inspection authority shall notify organizations and individuals involved in the production of products and goods (facilities subject to the inspection) at least 3 working days in advance.

- Regarding facilities subject to an approved inspection plan, according to actual situations or request of the management authority, if the inspection authority does not carry out the inspection at the facility subject to inspection, it shall send an official dispatch to such a facility to request for reports on compliance with laws concerning products and goods produced by the facility. If there are signs of violations of standards, measurement, quality, and goods labels through reports of the facility subject to inspection, the inspection authority shall conduct an irregular inspection according to (2). 

(2) Irregular inspection 

The inspection authority of the quality of products and goods shall carry out an irregular inspection of production when detecting one of the grounds prescribed in Clauses 1, 2, 3, 4, and 5 Article 4 of Circular No. 24/2023/TT-BKHCN.

Circular No. 24/2023/TT-BKHCN comes into force as of February 14, 2024.
