On September 19, 2024, the Ministry of Natural Resources and Environment of Vietnam issued Official Dispatch 6365/BTNMT-QHPTTND on the implementation of land use quotas for transportation in Vietnam

According to the content stipulated in Official Dispatch 6365/BTNMT-QHPTTND 2024, the Ministry of Natural Resources and Environment provides the followingguidance on the implementation of land use quotas for transportation in Vietnam:

At point d, clause 1, Article 243 of Land Law 2024 amended and supplemented some provisions of the Planning Law 2017, which stipulates that national land use planning content includes: Identifying land use quotas for agricultural land group, non-agricultural land group; in which specific areas of certain types of land including rice cultivation land, special-use forest land, protection forest land, production forest land as natural forest, defense land, and security land are determined.

Based on the above-mentioned regulations, the national land use planning indicator system will not regulate land use quotas for transportation in Vietnam.

Moreover, clause 2, Article 253 of Land Law 2024 stipulates: For localities with approved provincial planning for the period 2021 - 2030 according to the provisions of the Planning Law before the Land Law 2024 takes effect, they may continue using the land distribution and zoning plan of the provincial planning for land management until the end of the planning period.

Thus, from August 1, 2024, aside from the land use quotas in national land use planning mentioned above, the remaining indicators (including transportation land use quotas), the People's Committees of provinces and centrally-governed cities shall base on the land distribution and zoning plan in Provincial Planning and the Provincial Implementation Plan to proceed; for these remaining indicators, localities are not bound by Decision 326/QD-TTg 2022, Decision 227/QD-TTg 2024 of the Prime Minister of the Government of Vietnam.

For localities that do not have a Provincial Implementation Plan, the Ministry of Natural Resources and Environment respectfully requests that localities promptly prepare and submit the Provincial Implementation Plan for approval by the competent authorities; consider adjusting district-level land use planning if it does not align with provincial planning to organize land management in the locality.

The Ministry of Natural Resources and Environment requests the People's Committees of provinces and centrally-governed cities to pay attention and direct implementation.
