On February 21, 2025, the Office of the Government of Vietnam issued Notice 55/TB-VPCP regarding the conclusions of Deputy Prime Minister Tran Hong Ha at the meeting on the Decree providing detailed guidance on Resolution 171/2024/QH15 of the National Assembly on the pilot implementation of commercial housing projects through agreements on land use rights acquisition or holding.

In Notice 55/TB-VPCP in 2025, the Deputy Prime Minister of the Government of Vietnam requested that the Ministry of Natural Resources and Environment continue to compile and study the feedback from relevant ministries, sectors, localities, organizations, and individuals, focusing on completing the draft Decree providing detailed guidance on Resolution 171/2024/QH15 of the National Assembly regarding the pilot implementation of commercial housing projects through agreements on acquiring land use rights or currently having land use rights with the following directions:
- Clearly define the methods, procedures, dossiers, responsibilities, and specific authority of each agency for each case: real estate business organizations acquiring land use rights; cases where real estate business organizations have land use rights; real estate business organizations established by organizations currently using land to implement commercial housing projects on the site of production and business facilities that need to relocate due to environmental pollution, facilities to be relocated according to construction planning, urban planning, etc., to ensure practical implementation.
- Supplement regulations clearly outlining the principles, criteria, and priority order for selecting projects in the List of land plots proposed for pilot projects to ensure transparency (such as relocating polluted facilities, urban embellishment, areas with detailed planning, etc.), ensuring no situation of granting per request. Study and supplement transitional regulations, stipulate the responsibilities of project investors in arranging social housing according to housing law, and review to unify concepts in the draft Decree.
The Ministry of Natural Resources and Environment will continue to complete the draft Decree's dossier following the feedback from relevant ministries, sectors, localities, organizations, and individuals, submit it to the Ministry of Justice for appraisal according to related legal norms, and present it to the Government of Vietnam for consideration before March 10, 2025.
