On June 24, 2022, the Government of Vietnam issued Decree 43/2022/ND-CP on the management, use and exploitation of clean water supply infrastructure assets.
Article 5 of Decree 43/2022/ND-CP stipulating the methods of allocating clean water supply infrastructure assets in rural and urban areas in Vietnam as follows:
- Allocating clean water infrastructure assets in the form of increasing assets to:
+ Public non-commercial units as defined in Point a, Clause 1, Point a, Clause 2, and Article 5 of Decree 43/2022/ND-CP,
+ Commune-level People's Committees of Vietnam specified at Point b, Clause 1, Article 5 of Decree 43/2022/ND-CP.
- Allocating clean water supply infrastructure assets in the form of increasing state capital to:
Enterprises with foreign capital specified in Point c, Clause 1, Point b, Clause 2, Article 5 of Decree 43/2022/ND-CP to carry out clean water production and trading in accordance with regulations.
- Allocating clean water supply infrastructure assets to a specialized agency in charge of clean water supply for the preparation of exploitation plans by the following methods:
+ Auctioning assets to organizations to manage, use, and exploit the property for the purpose of producing and trading clean water if cannot allocate the assest to entities specified in Points a and b, Clause 3, Article 5 of Decree 43/2022/ND-CP.
+ Lease out the exploitation right or transfer for a definite time the right to exploit clean water infrastructure assets in case the property has been assigned to the commune-level People's Committees of Vietnam but the actual management, use, and exploitation is ineffective.
