The National Assembly of Vietnam passed the Law on Prevention and Control of Domestic Violence 2022 on November 14, 2022.
The regulations on measures to prevent domestic violence acts in Vietnam include:
(1) Compelling the cessation of domestic violence acts;
(2) Requiring the person committing domestic violence to report to the headquarters of the commune police where the domestic violence occurred;
(3) Prohibiting contact;
(4) Arranging temporary shelters and supporting essential needs;
(5) Caring for and treating the person subjected to domestic violence;
(6) Providing legal aid and psychological counseling, and skills to cope with domestic violence acts;
(7) Educating and supporting the transformation of domestic violence behavior;
(8) Contributing feedback and criticizing the person committing domestic violence within the community;
(9) Performing community service;
(10) Implementing measures to prevent and ensure administrative violation handling according to the provisions of the law on handling administrative violations;
(11) Implementing measures to prevent and protect the victim according to the provisions of criminal procedure law for those committing domestic violence acts.
Thus, compared to the Law on Domestic Violence Prevention and Control 2007, the new regulations have supplemented the measures (2), (4), (5), (6), (7), (8), (9).
The Law on Domestic Violence Prevention and Control 2022 takes effect from July 1, 2023, and replaces the Law on Domestic Violence Prevention and Control 2007.
