Matters That Bailiffs Are Absolutely Prohibited from Doing from February 24, 2020

Recently, the Government of Vietnam issued Decree 08/2020/ND-CP on the organization and activities of judicial officers, replacing Decree 61/2009/ND-CP and Decree 135/2013/ND-CP.

This Decree regulates that, from February 24, 2020, Bailiffs are prohibited from engaging in the following activities:

- Disclosing information about the performance of their duties, except where otherwise stipulated by law;- Utilizing information about Bailiff activities to infringe upon the lawful rights and interests of individuals, agencies, or organizations;- Demanding any additional material benefits beyond the costs recorded in the contract;- Concurrently holding positions as notaries, lawyers, valuators, auctioneers, asset managers, or liquidators;- While executing their duties, not taking on matters related to the rights and interests of themselves or their relatives, including: Spouse, children; biological parents, adoptive parents, etc., of the Bailiff, of the Bailiff's spouse; nieces and nephews where the Bailiff is the grandparent, uncle, aunt;- Other activities prohibited by law.
