Recently, the Minister of Transport issued Circular 12/2022/TT-BGTVT specify the list of potentially unsafe commodities in Vietnam
According to the Circular in Vietnam, HS code of tractors (used to tow semi-trailers) in Appendix I in addition to HS code 8701.20 also applies to codes implemented since the date the Circular takes effect and replaces Circular 65/2017/TT-BTC, including: 8701.21; 8701.22; 8701.23; 8701.24; 8701.29.
In addition, the management principles of the list of potentially unsafe commodities in transport sector are as follows:
- Imported commodities on the list specified in Appendix I and Appendix II issued together with Circular 12/2022/TT-BGTVT must be registered for state inspection in Vietnam. (New point)
- If there is only a 4-digit code, all 8-digit commodities in the same 4-digit heading are applied if conformable with the name specified in the certificate of quality.
- If there is only a 6-digit code, all 8-digit commodities in the same 6-digit heading are applied if conformable with the name specified in the certificate of quality.
- In case the HS code specified in Appendix I, Appendix II issued together with Circular 12/2022/TT-BGTVT is different from the HS code in the List of commodities for export and import of Vietnam issued by the Ministry of Finance of Vietnam, the HS code issued by the Ministry of Finance of Vietnam shall be applied. Circular 12/2022/TT-BGTVT takes effect from August 15, 2022, replacing Circular 41/2018/TT-BGTVT.
