List of Expenses Permitted When Executing Civil Judgments

Circular 43/2018/TT-BQP has just been promulgated by the Ministry of National Defense to stipulate the contents of expenditures, spending levels to ensure the operational activities of judgment enforcement, and the budget for the enforcement of civil judgments (THADS).

Some specific expenses to ensure the enforcement of judgments include:

- Payment of special allowances for the positions of Executors, Examiners, and Enforcement Secretaries;- Expenses for management, guidance, directing operations, and organization of civil judgment enforcement;- Expenses to ensure the verification and valuation of assets;- Expenses for sending, keeping, preserving, and destroying evidence and assets;- ...

In cases where a decision for enforcement by compulsory measures is issued, the enforcement agency is allowed to advance funds to organize the enforcement. After the enforcement is carried out and funds are collected, the advanced amount must be reimbursed.

Funds to ensure the enforcement activities are carried out according to the provisions stipulated in Circular 200/2016/TT-BTC. For civil judgment enforcement operations, the budget is allocated based on the annual budget estimates, enforcement fees, and other legitimate sources.

Circular 43/2018/TT-BQP takes effect from May 5, 2018.
