Law on Organization of People's Courts 2024 will come into force in Vietnam from January 01, 2025

June 24, 2024, Law on Organization of People's Courts 2024 was passed by the 15th National Assembly of the Socialist Republic of Vietnam, 7th Session.

Law on Organization of People's Courts 2024 will come into force in Vietnam from January 01, 2025

Article 4 of the Law on Organization of People's Courts 2024 stipulates the organization and jurisdiction for the establishment and dissolution of the People's Courts in Vietnam as follows:

- The organization of the People's Courts includes:

+ The Supreme People's Court;

+ The High People's Courts;

+ The Provincial and Central-affiliated City People's Courts;

+ The District, Urban District, District-level Town, Provincial City, and Central-affiliated City People's Courts;

+ Specialized First-Instance Courts in Administrative Affairs, Specialized First-Instance Courts in Intellectual Property, Specialized First-Instance Courts in Bankruptcy (hereinafter collectively referred to as Specialized First-Instance Courts);

+ The Central Military Court, the Military Region Courts and equivalent, the Regional Military Courts (hereinafter collectively referred to as Military Courts).

- The jurisdiction for the establishment and dissolution of the High People's Courts; the Provincial and Central-affiliated City People's Courts; the District, Urban District, District-level Town, Provincial City, and Central-affiliated City People's Courts; the Specialized First-Instance Courts; and the Military Courts is stipulated as follows:

+ The Standing Committee of the National Assembly decides on the establishment, dissolution, and determination of territorial jurisdiction of the High People's Courts, the Specialized First-Instance Courts; and the establishment and dissolution of the Provincial and Central-affiliated City People's Courts, the District, Urban District, District-level Town, Provincial City, and Central-affiliated City People's Courts upon the proposal of the Chief Justice of the Supreme People's Court;

+ The Standing Committee of the National Assembly decides on the establishment, dissolution, and determination of territorial jurisdiction of the Military Region Courts and equivalent, the Regional Military Courts upon the proposal of the Chief Justice of the Supreme People's Court in agreement with the Minister of National Defense.
