Law on Data anticipated to be approved in Vietnam in May 2025

On July 23, 2024, the Standing Committee of the National Assembly promulgated Resolution 48/2024/UBTVQH15 adjusting the program on law and ordinance formulation in 2024 in Vietnam.

According to Resolution 48/2024/UBTVQH15, the National Assembly will discuss the Data Law project at the 8th session (October 2024) and pass it at the 9th session (May 2025).

Authority delegations for the submission, review, participation in review, and progress of the submission to the Standing Committee of the National Assembly for the Data Law project are as follows:

- Submitting agency: the Government of Vietnam- Leading review agency: National Defense and Security Committee- Participating review agencies: Ethnic Council and other Committees of the National Assembly- Progress of submission to UBTVQH: 37th session (September 2024)

Responsibilities of Agencies, Organizations, and National Assembly Delegates in Proposing the Creation of Laws and Ordinances

- Before proposing the creation of laws and ordinances, agencies, organizations, and National Assembly delegates must undertake or request competent agencies and organizations to conduct the following activities:

+ Summarize the enforcement of laws related to the proposed creation of laws and ordinances; survey and evaluate the actual state of social relations related to the proposed creation of laws and ordinances;

+ Organize scientific research on relevant issues to support the proposal of creating laws and ordinances; research information, materials, international treaties which the Socialist Republic of Vietnam is a member related to the proposed creation of laws and ordinances. If necessary, request relevant agencies, organizations, and individuals to provide documents and information related to the proposed creation of laws and ordinances;

+ Develop the content of policies in the proposed creation of laws and ordinances; evaluate the impact of the policies;

+ Estimate resources and conditions to ensure the implementation of the laws and ordinances after being passed by the National Assembly and the Standing Committee of the National Assembly.

- Prepare the dossier for proposing the creation of laws and ordinances as stipulated in Article 37 of the Law on Promulgation of Legislative Documents 2015.

- Organize to collect opinions from relevant agencies, organizations, and individuals on the proposal to create laws and ordinances; compile, research, explain, and incorporate feedback.

- For proposals to create laws and ordinances not submitted by the Government of Vietnam, the proposing agencies, organizations, and National Assembly delegates have the responsibility to collect opinions from the Government of Vietnam and research, incorporate the feedback from the Government of Vietnam.
